Sertanejo Design produces interior and spatial design work for residential, commercial, and civic clients in the south reach. Operations

What They Don't Talk About

The Sertanejo commission agreement — the standard contract signed by all clients before work begins — includes in its intellectual property section a clause defining the treatment of design documentation. The clause states that all design work produced under the commission — drawings, specifications, material selections, concept documentation, photographs, and any other documentation produced in connection with the project — is the intellectual property of Sertanejo Design and may be used by Sertanejo for portfolio, promotional, educational, and commercial purposes without further client consent.

The clause is explained to clients as standard for design practice — a statement that the practice retains its own work product. In the context of the initial contract conversation, it is described in terms of the design process documentation: the sketches and specifications the studio produces.

What the clause covers, as written, is broader. It covers photographs of completed residential interiors — the private living spaces of clients who commissioned the work. It covers spatial documentation of commercial projects that clients have not publicly released. Sertanejo's design team routinely photographs completed commissions and uses those photographs in its portfolio and marketing materials. For commercial and civic clients, this is expected and causes no difficulty. For residential clients, it means that photographs of their private homes are in Sertanejo's portfolio and on its marketing channels, taken under a clause signed before they understood its application.

Several residential clients have raised objections after discovering their homes in Sertanejo's promotional materials. Sertanejo's legal team has responded that the commission contract covers this use. The objections have not produced litigation. They have not produced a contract revision.


Gameplay Relevance
